Federal Judge BLOCKS California’s High-Capacity Magazine Ban

Federal Judge Roger Benitez has granted an injunction filed by the NRA to stop California’s magazine ban. Earlier in the year, the California Assembly passed a bill that would prohibit even possessing a magazine of 10 rounds or more. For many years, it had been legal to own such a magazine, just not legal to purchase one.

On Thursday, San Diego based Judge Benitez issued the ruling, citing “Any previously law-abiding person in California who still possesses a firearm magazine capable of holding more than 10 rounds will begin their new life of crime.”

“If this injunction does not issue, hundreds of thousands, if not millions, of otherwise law-abiding citizens will have an untenable choice: become an outlaw or dispossess one’s self of lawfully acquired property,” Benitez continued.

Former Congressman and now California state Attorney General Xavier Becerra has supported the law and will likely seek to overturn Judge Benitez’s ruling.

This is a big win for California gun owners, and a big loss for Governor Jerry Brown and Michael Bloomberg.
