WATCH: Mamdani’s Viral Video Collapses Under Basic Fact-Checking (VIDEO)
On July 21, 2026, New York City Mayor Zohran Mamdani released a video in which he claims, among other things, that Israeli Prime Minister Benjamin Netanyahu is a war criminal. But to what extent, if any, are his arguments substantiated by available evidence?
The video can be broken down into three central claims: 1). Benjamin Netanyahu is a war criminal; 2). The United States should join the ICC and execute the arrest warrant issued against him; 3). Justice requires that the warrant be enforced regardless of politics.
Let us address each.
To begin with, Mamdani follows his initial claim by describing Netanyahu as the “architect of a horrific genocide against the Palestinian people.” His framing ignores the fact that “genocide” is a legal term, explicitly defined under the UN’s Convention on the Prevention and Punishment of the Crime of Genocide in 1948.
In Article II of the Convention, “genocide” is described as “acts committed with the intent to destroy a national, ethnical, racial, or religious group,” and sets one of the highest thresholds of proof in the legal world. This special intent is referred to as dolus specialis, and Israel’s stated campaign goals — those being the elimination of Hamas, the return of hostages, and long-term security — do not by themselves establish it.
Unfortunately, civilian casualties are often a natural consequence of war. The simple fact that they are occurring, even on a large scale, does not immediately imply genocidal intent according to the Conventions.
The fundamental question, as it stands under the Convention, is not whether there has been immense civilian suffering or whether Israel has violated international and humanitarian law, but whether Israel has a particular intent to destroy Palestinians as a group, either wholly or partially. As it stands, that is a high bar, and the International Court of Justice has not reached a final verdict issued on the question.
The second claim should first be addressed by stating that the United States has declined to ratify the Rome Statute since the Clinton administration in 1998. Mamdani frames our membership as a moral given, despite the historical fact that presidents of both parties have treated the surrender of jurisdiction of U.S. nationals with suspicion. This, most recently, includes a letter written on July 2 by Todd Blanche to the President of the ICC.
It is, ultimately, a question of national sovereignty, with the United States maintaining that its own domestic judicial systems are sufficient to prosecute allegations charged against Americans.
Additionally, critics have pointed to flaws in the ICC’s practices that conflict with the American governmental structure. This includes a lack of checks and balances, an absence of jury trials, and excessive discretionary power exercised by judges.
The United States continues to assert that a treaty cannot bind a country that has not agreed to it. If one were to follow that logic, whether or not Israel — a country that has also never agreed to join the ICC — is under the legitimate authority of the Court is contested as well.
With regard to Netanyahu, this indicates that there is no existing legal mechanism that allows the United States to enforce ICC warrants on a local, state, or federal level, as The Gateway Pundit previously reported.
Mamdani was right to concede this point, but any expectation that America will join the ICC is highly unsupported by historical precedent.
Lastly, Mamdani assumes that an issued warrant settles the matter of justice. The response is simple: an arrest warrant is not a conviction.
